We handled a case earlier this year, with an employee making an injury claim due to an accident within his workplace; he worked as a Warehouse Operative, and tripped on a box which had been erroneously placed on the ground in a walkway.

When he fell, he struck his knee on a wooden pallet. In consequence, he suffered a serious knee injury – the 58 year-old (at the time of the injury) was in constant pain, which negatively impacted his sleep and work. Not only this, but the symptoms from his pre-existing arthritis were accelerated by between two to three years, as a result of the fall.

Permanent damage was caused, which affected his general living, as he struggled to get up and down stairs, along with in and out of the bath. As well as this, his working life was disrupted, as he had to have regular breaks to manage the pain and swelling. The defendant (his employer), denied liability in the case, stating there was a safe system of work in place at the warehouse.

Kate Spence, instructed by Robert Hart of Accident Solicitors Direct for the claimant, saw a court award of £7,500 for the total damages. The client was pleased with the results, rating ASD 5 stars, stating: ‘They have helped me twice and twice I won my case, they are very understanding and patient with people.’
